The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to July 2010. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

Contains information about amendments which have come into force between June to July 2010. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of July 2010 under which they were made (Governing Act).

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): Proposed amendments are found in the Canada Gazette, Part I, May 2, 2009, p. 1376. Proposed Amendment 9 regulations are found in the Canada Gazette, Part I, April 10, 2010, p. 840. Proposed changes are to harmonise with the United Nations' requirements for drums used in the transport of dangerous goods.

Vessel Operation Restriction Regulations (Canada Shipping Act, 2001): Proposed amendments are found in the Canada Gazette, Part I, May 1, 2010, p. 1082.

Wastewater Systems Effluent Regulations (Fisheries Act): Proposed regulations are found in the Canada Gazette, Part I, Mar. 20, 2010, p. 511.

Concentration of Phosphorus in Certain Cleaning Products Regulations (Canadian Environmental Protection Act, 1999 ): SOR/2009-178 is now in force amending the title of the regulations (formerly Phosphorus Concentration Regulations). Section 3 is replaced and new sections 4 - 8 have been added regarding household dishwashing compounds, household cleaners, accreditation by a laboratory and record keeping.

Occupational Health and Safety Regulation (Workers Compensation Act): The new 2010 Proposed Amendments for Consultation are to be found on the Worksafe BC website. Consultation period ends 4:30 pm Friday, June 4, 2010.

Carbon Tax Act: S.B.C. 2010, c. 6 amends subsections 57(1) and (2) and 64(14)(b)(ii) by referencing the Supreme Court Civil Rules. S.B.C. 2010, c. 21 adds subsection 71(2) and makes further amendments to reflect this change.

Forest Act: S.B.C. 2010, c. 6 makes minor amendments to subsections 142.91(1) and (2). S.B.C. 2010, c. 11 amends subsection 8(5) and ss. 94 and 105 replaces clauses 75.1 (2)(a) and (b) and adds s. 94.1 regarding scaling of special forest products. Several other amendments are made regarding references to the minister. S.B.C. 2010, c. 21 adds paragraph 54(2)(d.1) and subsection 54(3). S.B.C. 2010, c. 22 amends clause 47.7(f)(ii) and adds Division 4.1 after section 79.

Foresters Act: S.B.C. 2010, c. 6 amends subsections 28(1) and (2) by referencing the Supreme Court Civil Rules.

Health Act: S.B.C. 2010, c. 6 amends subsection 9(4) by referencing the Supreme Court Civil Rules.

Passenger Transportation Act: S.B.C. 2010, c. 6 amends the definition of "temporary operating permit" and makes minor amendments to subsection 30(2) and clause 59(2)(p).

Protected Areas of British Columbia Act: S.B.C. 2009, c. 19 amends Schedules C and D. S.B.C. 2010, c. 13 makes several amendments to the Schedules of this Act.

Public Health Act: S.B.C. 2010, c. 6 amends ss. 117 and 118 by referencing the Supreme Court Civil Rules and adds subsection 9(2) referencing the Ministry of Health Act.

Utilities Commission Act: S.B.C. 2010, c. 22 replaces the definitions of "demand-side measure" and "Government's energy objectives" and repeals the definition of "transmission corporation". Further amendments are made reflecting these changes as well as referencing the Clean Energy Act.

Wildfire Act: S.B.C. 2010, c. 11 amends ss. 3 and 17, replaces subsection 17(4), adds paragraph 17(5)(a.1) and makes several other minor amendments. S.B.C. 2010, c. 22 amends subsections 7(3) and 43(3), adds subsections 7(2.1) and (2.2) and replaces paragraph 72(2)(g).

Workers' Compensation Act: S.B.C. 2010, c. 6 amends subsection 247(2) by referencing the Supreme Court Civil Rules.

Elevating Devices Safety Regulation (Safety Standards Act): B.C. Reg. 105/2010 amends Item 4 of the "Canadian Standards Association (CSA) Standards" table contained in the Schedule.

Highway Traffic Act: S.M. 2009, c.6 adds section 186.1 prohibiting smoking in motor vehicles if a child is present, and adds section 215.1 which prohibits the use of hand-operated electronic devices while driving.

Fire Prevention Regulations (Fire Prevention Act): R-035-2010 replaces paragraph 2(1)(c) to update the reference to CSA B139-09 Installation Code for Oil-burning Equipment, 2009 edition.

Environmental Protection Act: S.O. 1997, c. 7 replaces ss. 102 to 105 and repeals sections 106 to 121, resulting in the dissolution of the Environmental Compensation Corporation.

Provincial Offences Act: S.O. 2009, c. 33, Sch. 4 replaces s. 45 regarding a taking of plea and s. 83.1 regarding appearance by electronic method and adds subsections 111(4) and 159(1.0.1).

Designated Substances Regulation (Occupational Health and Safety Act): O. Reg. 259/10 replaces Table 1 outlining exposure limits.

General (Clean Water Act, 2006): O. Reg. 246/10 replaces ss. 19 to 23 and adds ss. 24 to 68 which provide enhanced requirements for preparing source protection plans. The legislation addresses municipal and public involvement in the planning process as well as providing interim authority to municipalities to manage significant drinking water threats. Further amendments are made to reflect these changes.

Records of Site Condition - Part XV.1 of the Act (Environmental Protection Act): O. Reg. 245/10 amends clause 21.1(1)(d) and replaces subsections 21.1.(2) and (3). Report Section 7 of Schedule C regarding the risk management plan is also replaced.

Regulation respecting the charges payable for the disposal of residual materials ((Environment Quality Act): Draft amendments are found in the Gazette officielle du Qu�bec, Nov. 25, 2009, p. 3885.

Regulation respecting the recovery and reclamation of products by enterprises (Environment Quality Act): The draft regulation is found in the Gazette officielle du Qu�bec, Nov. 25, 2009, p. 3871.

Regulation to amend the Regulation respecting occupational health and safety (An Act respecting occupational health and safety): Draft amendments are found in the Gazette officielle du Qu�bec, March 10, 2010, p. 674.

Regulation respecting occupational health and safety in mines (Act respecting occupational health and safety): Proposed amendments are found in the Gazette officielle du Qu�bec, Sept. 30, 2009, p. 3437.

Regulation respecting threatened or vulnerable wildlife species and their habitats (An Act respecting threatened or vulnerable species): Draft regulations are found in the Gazette officielle du Qu�bec, March 11, 2009, p. 533.

Regulation respecting waste water disposal systems for isolated dwellings (Environment Quality Act): Proposed amendments are found in the Gazette officielle du Qu�bec, January 23, 2008, p. 485. The amendments are in regard to non-watertight secondary treatment systems.

Regulation to amend the Construction Code (Building Act): Draft regulation is found in the Gazette officielle du Quebec, June 23, 2010, p. 1535.

Regulation to amend the Regulation respecting environmental standards for heavy vehicles (Environment Quality Act): Draft regulation is found in the Gazette officielle du Quebec, June 23, 2010, p. 1539.

Regulation to amend the Regulation respecting exemptions from the application of Title VIII.1 of the Highway Safety Code (Highway Safety Code): Draft amendments are found in the Gazette officielle du Quebec, Dec. 16, 2009, p. 4133.

Regulation to amend the Regulation respecting mandatory reporting of certain emissions of contaminants into the atmosphere (Environment Quality Act): Proposed amendments are found in the Gazette officielle du Qu�bec, June 9, 2010, p. 1398. The purpose of the draft Regulation is to make the reporting of greenhouse gas emissions compulsory.
